Jensen Law represents clients in Whitehorse and throughout the Yukon in criminal and related legal matters. We approach every case with careful preparation, sound judgment and a practical understanding of what is at stake for you — your licence, your job, your ability to travel and your record.
Impaired and dangerous driving cases often turn on roadside procedure, police observations, breath or blood testing, and how the evidence was obtained. Before recommending a strategy, we review the driving evidence, the legality of the stop, the timing of the breath demands, your Charter rights and the witness accounts. Some cases call for a Charter challenge or a trial; others are better resolved through negotiation. We help people facing impaired driving, over 80, refusal to blow and drug-impaired driving charges, as well as driver licensing issues.
Impaired and dangerous driving charges often begin with a roadside stop, a collision, a 911 call or a police observation made in a matter of minutes. Those early decisions — demands for testing, statements made at the scene and the evidence collected afterward — can shape the entire case. Even where the investigation moved quickly, the Crown still has to prove the charge, and the police must have acted within their lawful authority.
From Yukon DUI Lawyers: in the Yukon, police can impose roadside sanctions under the Motor Vehicles Act as well as laying Criminal Code charges. A 90-day licence suspension applies for impaired driving, a reading of 80 mg or more, or refusing a breath or blood demand, and the vehicle is impounded for at least 30 days on a first occurrence — doubled if the reading was over 160 mg or the driver refused. Yukon licence holders receive a 14-day temporary permit before the suspension begins. A conviction brings a driving disqualification and the ignition interlock program.
