Description

If you are looking for a lawyer who will fight zealously and passionately for you in court, I can help. I am a Whitehorse barrister and solicitor focused on criminal litigation and appeals, called to the Yukon, British Columbia and New York bars, and to the Québec Bar as a Canadian Legal Advisor. I routinely accept cases from the Yukon, British Columbia and Québec.

Criminal trials and expert evidence

I have extensive trial and appellate experience defending people facing everything from serious charges to less serious criminal matters. I have cross-examined numerous expert witnesses, including in toxicology and drug analysis — evidence that often arises in impaired driving and over 80 cases — and I bring my background in mathematics and science to challenging the assumptions experts rely on. I also handle Charter litigation, which can be central to challenging a roadside stop or breath demand.

My approach

I believe effective courtroom advocacy requires a blend of knowledge, passion and creativity. In R. v. Penunsi (2019 SCC 39), I intervened in the Supreme Court of Canada on behalf of the Yukon Legal Services Society to explain the Northern reality to the country’s top court. I bring the same preparation to every trial, whether the charge is serious or less serious.

Practice areas

Experience

  • Regular appearances before Courts of Appeal across Canada and the Supreme Court of Canada
  • Author of Dangerous Offender Law (LexisNexis, 2021)
  • Former law clerk at the Supreme Court of Canada; formerly with the Yukon Legal Services Society

Charged with impaired driving in the Yukon? Key facts

From Yukon DUI Lawyers: in the Yukon, police can impose roadside sanctions under the Motor Vehicles Act as well as laying Criminal Code charges. A 90-day licence suspension applies for impaired driving, a reading of 80 mg or more, or refusing a breath or blood demand, and the vehicle is impounded for at least 30 days on a first occurrence — doubled if the reading was over 160 mg or the driver refused. Yukon licence holders receive a 14-day temporary permit before the suspension begins. A conviction brings a driving disqualification and the ignition interlock program.
